Samsung-Apple war is a sophisticated patent war and “Who is Winning?” still remains a question to be determined by the courts and market. The patent war involves phone companies Samsung and Apple where Apple company sought litigation in California over patent infringement by Samsung. On the same line Samsung also sued Apple in Japan. This war continues since Samsung has still gone ahead to sue Apple for infringement of their mobile broadband patent.
In this war, Samsung prefers to take their competition on innovations to the market while Apple company is reserved and prefers the issues to be settled in court. Determination of the winning company therefore remains to be seen in the market according to Samsung and court decision according to Apple. However, either ways both the companies are prone to lose.
The Samsung-Apple war has got different rulings of the courts and this makes it difficult to tell who is really winning. The Jury in California ruled in favor of apple for infringement of the patent since Samsung was guilty of copying Apple’s technology. However, a ban on Galaxy Tab 10.5 was lifted. In Japan also, Samsung lost case against Apple to stop sales of their iPhones in Japan as it was found that Apple did not infringe patent rights.
It is worth noting that both the companies view each other as future threats in this war and will do everything it takes to win the patent war. This is evident in the recurrence of court cases involving the companies over smart phones’ patent rights. Currently Samsung has a case against Apple iPad, iPhone and iPod touch which is to be determined in March 2014.
There are several dynamics revolving around the Samsung-Apple war and it’s not going to end soon since all the companies are looking forward to dominating the smart phone market and patent rights. The two remain the giants in the smartphone market and that is the basis of holding on to the war to command the greatest share.
